CONDITIONS OF USE

TERMS OF USE

By accessing and using the Online databases of Standards Map (hereafter referred to collectively as the “Database”) of the International Trade Centre (hereafter referred to as the “International Trade Centre” or the “Organization”), Users agree to be bound by the following terms of use as amended from time to time and all terms and conditions, including the Privacy Policy, contained or referenced on the Organization’s website www.intracen.org (hereinafter referred to collectively as the “Terms of Use”).

GENERAL DISCLAIMER

  1. The Databases can be accessed from www.standardsmaps.org. The copyright to the Portal and Database belongs to the International Trade Centre. 
  2. Users are responsible for the use of their account, username and password according to the Terms of Use. Users are responsible for protecting the confidentiality of their username and their password. 
  3. Except in circumstances outside its control, the International Trade Centre is responsible for ensuring the accessibility of the Portal and Databases. The Helpdesk will operate and maintain the Portal and Database during Swiss working hours, unless otherwise agreed. The International Trade Centre reserves the right to change or discontinue any aspect or feature of the Database. 
  4. The collection and retention of identifiable information by the International Trade Centre through the Database is subject to the terms of the Privacy Policy.   
  5. Users acknowledge and agree that while the Portal and Database allow the User to perform comparisons of standards, the International Trade Centre is not responsible for any business decision developed using or based on the Portal or the Databases findings. 
  6. The International Trade Centre makes every effort to ensure, but cannot and does not guarantee, and makes no warranties as to, the accuracy, accessibility, integrity and timeliness of information presented on the Portal and Database. The International Trade Centre assumes no liability or responsibility for any errors or omissions in the content of the Portal and Database. Users acknowledge and agree that the use of the International Trade Centre’s Portal and Database is at their sole risk. Users acknowledge and agree that the International Trade Centre makes no warranties, guarantees, covenants or representations as to the fitness for a particular purpose of any content of the Portal and Database, whether express or implied, oral or written. The International Trade Centre disclaims any liability or responsibility for any financial, reputational or other consequences whatsoever arising from the use of such information. Under no circumstances, including but not limited to negligence, shall the International Trade Centre or any content providers, be liable for any direct, indirect, incidental, special or consequential damages of any kind, including any loss of business or profits, arising from the use, inability to use or reliance on the information contained in the Portal or Database.   
  7. Information, text, graphics or hyperlinks to other websites that may appear in the Portal and Database are provided solely as a resource and convenience to Users. Hyperlinks to other websites do not imply any approval or endorsement by the International Trade Centre of the information contained in those other websites. The International Trade Centre makes no warranty, either express or implied, as to the accuracy or reliability of such information, text, graphics or hyperlinks. The International Trade Centre has not tested any software located on other sites and does not make any representations as to the quality, safety, reliability or suitability of such software. 
  8. Users acknowledge and agree that the internet and the worldwide web are unpredictable and may, from time to time, be disrupted and impede access to the Database. Users acknowledge and agree that the International Trade Centre is in no way responsible for any such disruptions or interferences and Users expressly waive, discharge and release any and all claims against the International Trade Centre in connection therewith. 
  9. Users are authorised to consult, download and reproduce to a reasonable extent information presented on the Portal and the Databases, subject to any specific terms of use that might appear with such information, for their own, private, non-commercial use provided that the source of information is acknowledged, as follows Standards Map, International Trade Centre, www.standardsmap.org”
  10. The International Trade Centre is a joint subsidiary organ of the World Trade Organization and the United Nations and enjoys Privileges and Immunities by the Convention on Privileges and Immunities of the United Nations of 13 February 1946. Any dispute, controversy or claim between a User and the International Trade Centre arising out of the Terms of Use or the breach thereof shall be settled by arbitration pursuant to the arbitration rules of the United Nations Commission on International Trade Law (UNICITRAL) then obtaining.  Nothing herein or related to the Terms of Use shall constitute or be considered to be a limitation upon or a waiver of any of the privileges and immunities of the International Trade Centre, which are specifically reserved. 
  11. By accessing and using the Database, Users agree to periodically review the Terms of Use and to be bound by any future changes, modifications, or additions thereof. Any use of the Portal and Database after any such changes, modifications, or additions shall be governed by the Terms of Use as revised. The International Trade Centre reserves the right to modify the Terms of Use at any time without notice. 
  12. Failure to comply with the above shall constitute a breach of these Terms of Use, which may result in the immediate termination of the User’s account and access rights to the Portal and Database. Nothing in the Terms of Use may be interpreted to reduce, limit, or restrict the exclusive rights of the owners of the information, documents and materials contained in the Portal and Database.   

CUSTOMISED VERSION

  1. Institutions may purchase for an additional fee a customised version of the Standards Map portal. To do this, institutions will sign a Memorandum of Understanding (MOU) with the International Trade Centre that sets out conditions of access and the subscription fee.
  2. Holders of a customised version of the Standards Map portal License may customise the Standards Map self-assessment questionnaire and benefit from additional services to Users who respond to their customized questionnaires. A customised version of the Standards Map portal is, in most cases referred to as “Standards Map {Institution Name}”, where the institution name is the name of the register institution.
  3. The holder of a customised version of the Standards Map portal is provided with a confidential, primary username and password for its customisation of its self-assessment questionnaire version. The holder of a customised Standards Map License is not authorised to publish, disseminate, sell or share its primary username and password with any third parties other than those specified in the MOU between the International Trade Centre and the holder.
  4. The holder of a customised Standards Map License is authorised to disseminate access to its customised version of the Standards Map portal to selected third parties of its own institution. Access by third parties is only authorised with a different, secondary username and password obtained from the Portal via the registration web page.
  5. The International Trade Centre reserves the right to change the username and password of a Standards Map License holder or any third party from time to time giving one (1) month’s notice in writing, by email, mail or fax.
  6. The holder of a Standards Map License is authorised to pass on and disclose any data and analysis extracted from its customised Portal, provided that the source of the data is acknowledged as follows: ” Standards Map, International Trade Centre, www.standardsmap.org”.

DATA PROTECTION POLICY

1. Introduction

1.1 – ITC recognizes the immense potential of new technologies for its trade related technical assistance activities, and we aim to incorporate them into our activities. We are also deeply aware of the risks involved, and of the importance of developing appropriate data protection standards and putting them into effect. As a result, ITC has adopted the Policy which enables us to undertake our operations whilst safeguarding individual personal data.
 
1.2 – ITC is committed to safeguarding the privacy of our website visitors and securing the personal information made available by users of ITC websites as well as ITC web pages on other sites (such as official ITC profiles on social networks) (hereinafter the “Website”). In this Policy we explain what information and data we collect and how it is used, stored and shared.
 
1.3 – Any information voluntarily disclosed to ITC by users of our Website is held with the utmost care and security and will not be used in ways other than as set forth in this Policy.
 
1.4 – Providing information is your choice. When you undertake certain actions on our Website, such as signing up for email newsletters, or filling in a form to register your interest in our activities, you knowingly provide us with personal information about you, such as your name, email address, postal address and other information. We use this voluntarily provided personal information in order to interact with you and provide relevant services and information on ITC work that may be of interest to you.
 
1.5 – We will not make public your personal information without your consent. We do not sell your personal information voluntarily disclosed to us with anyone outside ITC. If you provide your personal information when joining us online or signing up for specific services, you will only be contacted by ITC for purposes related to the work of ITC and you can request to have your name removed from our mailing list at any time.
 
1.6 – By using our Website and agreeing to this Policy, you consent to share your data in accordance with the terms of this Policy.

if you are a “Producer / Grower” user: business name, business type, business location, products or services and affiliation with project partners ; Following the provision of the aforementioned information, users may decide to supplement their profile by including additional information about their businesses, product and or services, geo-locations of business headquarters and production / processing sites, sustainability assessment, compliance to existing certification together with proof of compliance, and various media depicting production and processing sites, techniques and product.
if you are either a “Processor” or “Buyer & Retailer”: business name, business type, business location, products or services and affiliation with project partners ; Following the provision of the aforementioned information, users may decide to supplement their profile by including additional information about their businesses, product and or services, geo-locations of business headquarters and production / processing sites, sustainability assessment, compliance to existing certification together with proof of compliance, and various media depicting production and processing sites, techniques and product, together with information pertaining to your sustainability network.
(d) information that you provide to us for the purpose of subscribing to our email notifications and/or newsletters (including your name and email address)];
(e) information that you provide to us when using the services on our Website, or that is generated in the course of the use of those services (including the timing, frequency and pattern of service use)];
(f) information that you post to our Website for publication on the internet (including your user name, your profile pictures and the content of your posts])];
(g) information contained in or relating to any communication that you send to us or send through our Website (including the communication content and metadata associated with the communication])]; and

2.3 – Any inappropriate content will be removed from our Website and social media accounts. If in doubt, please do not share your content with ITC. If you post on, or transmit to, our Website any material of the type prohibited under the above paragraphs or any applicable laws and regulations, and ITC incurs any costs, expenses, liability or losses as a result then you agree to indemnify ITC for all such costs, expenses, liability or losses.

If you are a “Processor” or “Trader & Retailer:
business name, business type, business location, products or services and affiliation with project partners ;
Additional information provided regarding your business, product and or services, geo-locations of business headquarters and production / processing sites, sustainability assessment, compliance to existing certification together with proof of compliance, and various media depicting production and processing sites, techniques and product, and anonymized network.
(l) send you notifications from companies wanting to contact you];
(m) use business profile information to generate aggregated and fully anonymized analytics depicting average company sustainability at a national level across specific products/services;
(n) use business profile information to enable companies to compare their sustainability performance against anonymised aggregated business profile information sets across specific products/services at a national level;

 

4. Disclosing personal information

4.1 – We may disclose your personal information:
(a) to the extent that we are required to do so by applicable law;
(b) in connection with any ongoing or prospective legal proceedings; and
(c) in order to establish, exercise or defend our legal rights.
 
4.2 – We may disclose your personal information to any of our officials, professional advisers, consultants, suppliers, subcontractors and auditors insofar as reasonably necessary for the purposes set out in this Policy.
 
4.3 – We may disclose your personal information to any other agency of the United Nations, international organization, public and private sector entity insofar as reasonably necessary for the purposes set out in this Policy. Any compliance with national data protection legislation or cooperation with national or regional data protection authorities is always without prejudice to ITC’s privileges and immunities under domestic and international law. You note that ITC cannot be compelled to disclose any information acquired while carrying out its work. More specifically, the ITC privilege of non-disclosure must be respected.
